MEMBERSHIP: TERMS AND CONDITIONS

On becoming a premium member of Creative Circle Philippines, you hereby agree to be bound by the Membership Agreement which will govern our relationship with you. 

The information which you have provided us at the point of registration is important and hereby warrant that such information is accurate, true and up-to-date. You will also undertake promptly to inform us of any changes to the information provided. 

Terms of Membership:

1. To be an eligible member, you must be an Individual identified as  creator, producer, maker, crafter, artist, artisan, small-scale or medium-sized manufacturer, or innovator.

2. The products or items you sell are all original creations, locally produced and you own the rights to the products or items.

3. The member's membership cannot be shared or transferred to anyone else.

4. The membership will start at the closing of the annual registration (usually, March 31) and will continue until the registration for membership renewal re-opens in the following year (usually between January to March).

5. Duties and Responsibilities. The member promises to follow all the rules and conditions of this Agreement and the Program which includes but not limited to:

5-a. Respect other members' rights and abide by any guidelines about the use of shared resources.

5-b. Do not engage in any activities that could harm the reputation of the company or any of its programs made available for the members.

5-c. Comply with any other conditions outlined in this Agreement or in any of the program guidelines accessible to members.

5-d. Actively participate in community activities and programs.

5-e. Support the mission, vision, and goals of the organization and its programs.

5-f. Adhere to the policies and procedures of the organization set out in this agreement and future guidelines rolled out by the management.

5-g. Support the organization's operations by using its services, sharing resources or contributing to the delivery of services.

5-h. All members must adhere to the implementing rules and regulations of the Data Privacy Act.

6. Annual Dues. Membership fee costs Php300.00 per month and paid in full annual package upon membership registration. The total annual fee costs Php3,600.00 in total and this amount is paid during the member's registration.

7. Members Benefits. Premium members have the following benefits:

7-a. Membership card, renewed annually.

7-b. (4) Four hours free one-on-one mentorship session via Zoom. (T&C applies).

7-c. Exclusive discounts and special offers from Creative Circle Philippines and its select partners, collaborators and supporters.

7-d. First access to the following discounted events, activities and programs: (a) annual popup market booth organized by the Circle; (b) creative workshops under Creative Workshops Studio; (c) business trainings offered by the Circle; (d) mentorship sessions; (e) marketing services; (f) quarterly business networking events; (g) other services by Creative Circle Philippines and its partner communities.

7-e. Access and linkages to the Circle's partner communities for collaboration.

7-f. Access to the Circle's for-impact initiatives such as the Biggest Garage Sale and Reuse+Repurpose Resource Repository.

8. Membership cancellation. If you decide to cancel your membership, Creative Circle Philippines shall only be responsible for keeping any content or information one (1) month after the cancellation date. After one month, all date may be deleted. When you cancel membership:

8-a. Your current membership cycle ends.

8-b. Any and all membership dues and/or program fees are non-refundable and non-transferrable.

8-c. You will no longer have access to any membership privileges of Creative Circle Philippines once you have canceled your Membership assuming there is no conflict of interest.

8-d. To rejoin, you will need to re-apply and pay any re-initiation fees that apply. All re-applications are subject for review.

9. Members agree to hold the Creative Circle Philippines team and executives, partners, collaborators, supporters, its staff, volunteers and other stakeholders free of any liability, charges and claims for any losses or damages that may arise as a result of your participation in the Company’s Website, Programs, Classes, Trainings, Meetups, Events, Support Groups, Memberships, Products, Services or Program Materials.

10. Creative Circle Philippines does not carry insurance to cover theft, loss, or damage to your work or personal property, personal injury to you or your helpers, or liability insurance protection for members. The applicant agrees and releases Creative Circle Philippines from any damage to personal property or personal injury, which he/she, or helpers may sustain while participating in this program.

11. Creative Circle Philippines reserve the right to make changes or updates at any time and hereby informs all members that the burden is on the members to check for updates on this Agreement and Disclaimer from time to time as communicated to all members via email.

12. Assumption of Risk. From time to time, individual risks and circumstances can arise from use of Company’s Website, Programs, Classes, Trainings, Meetups, Events, Support Groups, Memberships, Products, Services or Program Materials that are not foreseen and can influence or reduce results.

12-a. Members shall not hold Creative Circle Philippines responsible for personal choices, actions or consequences as a result of use of our Website, Programs, Classes, Trainings, Meetups, Events, Support Groups, Memberships, Products, Services or Program Materials, which were taken or occurred before, during or after use of our Website, Programs, Classes, Trainings, Meetups, Events, Support Groups, Memberships, Products, Services or Program Materials.

12-b. You understand that any mention of, suggestion of, or recommendation of products or services through the Company Website, Programs, Classes, Trainings, Meetups, Events, Support Groups, Memberships, Products, Services or Program Materials is to be taken at your own risk, with no liability on the part of the Company, recognizing that there is a rare chance that financial loss, illness, injury or even death could result.

12-c. Members accept full responsibility for the consequences for your use, or non-use, of any information provided by Company through any means whatsoever. Your use or non-use is at your own risk and you absolve the Company of any liability or loss that you, your business, family, children, team members, employees, affiliates, or any other persons, may incur from your or their use, or non-use, of the information provided.

13. Creative Circle Philippines reserve the right to refuse any application for Membership or renewal.

14. Disclaimers. Information is shared through Creative Circle Philippines in good faith and there are no explicit or implied guarantees or warranties to the veracity or applicability of the information shared within the organization by individual members, and Members agree that such information is provided “as is”.

14-a. Information received from any Creative Circle Philippines' service, product, or member must be analyzed fully by the receiving party, and inherent risks determined and understood. Any local action taken must be informed by local technical expertise and applied as appropriate to the local technical, functional, and cultural environments. Each Member is solely responsible for its own actions and determinations.

14-b. The Creative Circle Philippines team, its sponsoring organizations, and members accept no responsibility for negative impacts of any sort that results from local actions taken on information distributed within or by Creative Circle Philippines publicly, to the membership generally, or to specific individuals.

15. Dispute Resolution. Any dispute, controversy or claim arising out of or relating to this Agreement or the breach, termination or validity thereof (“Dispute”) which arises between the Creative Circle Philippines and the member shall first be negotiated between appropriate senior executives of Creative Circle Philippines and the member who shall have the authority to resolve the matter.
